Terms and Conditions

Sunshine Bridge Education Terms and Conditions

Effective from: 18th September 2026 

These Terms and Conditions apply to students enrolled with Sunshine Bridge Education (“SBE”, “we”, “us” or “our”).

By completing the enrolment process and ticking the acceptance box in the SBE Google Form, the parent or legal guardian (“parent” or “you”) confirms that they have read, understood and agreed to these Terms and Conditions.

 

1. Enrolment and supervision

  1. You authorise SBE and its staff to care for and supervise your child while they are attending SBE or participating in an activity supervised by SBE.

  2. SBE will take reasonable care to provide a safe, supportive and inclusive environment.

  3. You authorise SBE staff to take reasonable action considered necessary to protect the safety and wellbeing of your child, other students and staff.

  4. Your child’s regular enrolled day or days are reserved specifically for them for the duration of the term.

  5. Fees remain payable when your child is absent for any reason, including illness, appointments, family holidays, travel or other personal circumstances.

  6. Fees reserve your child’s ongoing place and contribute towards staffing, premises, materials and operating costs that continue regardless of individual attendance.

  7. If an enrolled day falls on a public holiday, SBE will be closed and no fee will be charged for that day.

 

2. Absences and make-up sessions

  1. If your child is unable to attend, you should notify SBE as soon as reasonably practicable.

  2. When your child misses their regular session, SBE will endeavour to offer a suitable make-up session where availability allows.

  3. Make-up sessions:

    • are subject to available places;

    • cannot be guaranteed;

    • may be offered on a different day or in another suitable group; and

    • do not entitle the family to a refund or fee reduction if no suitable place is available.

  4. SBE may decline a make-up session where it would affect staffing, group numbers, student needs or the safe and appropriate operation of a class.

 

 

3. Fees and payments

  1. You agree to pay all fees associated with your child’s enrolment by the applicable due dates.

  2. Families paying directly may pay their term fees either:

    • in full at the beginning of the term; or

    • in two instalments, with the first half payable at the beginning of the term and the remaining half payable by the date advised by SBE.

  3. Families using an approved automatic payment arrangement will make payments according to that arrangement.

  4. SBE may provide invoices, account statements and payment reminders showing amounts owing.

  5. Failure to pay fees when due may result in SBE suspending or ceasing services until:

    • the account is brought up to date; or

    • an agreed payment arrangement is in place.

  6. If you are experiencing difficulty meeting a payment due date, you are encouraged to contact SBE as early as possible so that a reasonable payment arrangement can be discussed.

  7. Any fees already due, together with fees payable during an applicable notice period, remain payable if your child stops attending or their enrolment is cancelled.

 

4. Overdue accounts and debt recovery

  1. If an account becomes overdue, SBE may contact you to request payment and provide an opportunity to:

    • pay the outstanding amount;

    • discuss the account; or

    • enter into an agreed payment arrangement.

  2. If an account remains unpaid after reasonable notice has been provided and no satisfactory payment arrangement or communication has been received, SBE may refer the outstanding amount to an external debt-recovery agency or another appropriate recovery service.

  3. Where SBE incurs reasonable and documented third-party costs in recovering an overdue debt, SBE may seek recovery of those costs from you to the extent permitted by law.

  4. SBE may decline future enrolment or re-enrolment while an account remains overdue.

 

5. Withdrawal and changes to enrolment

  1. At least four weeks’ written notice is required to withdraw your child completely from SBE.

  2. Fees remain payable throughout the four-week notice period, regardless of whether your child attends during that period.

  3. At least two weeks’ written notice is required when reducing the number of days your child attends while otherwise maintaining their enrolment.

  4. Fees for the existing enrolled days remain payable throughout the applicable notice period.

  5. Written notice must be provided through an SBE-approved communication channel and takes effect when received by SBE.

  6. If your child’s enrolment has ended and the account has a genuine credit balance after all fees and adjustments have been finalised, you may request a refund.

  7. SBE may allow up to five business days to process a refund so that payments, third-party funding and account adjustments can be finalised.

 

6. Sessions cancelled by SBE

  1. If SBE cancels a scheduled session, we will endeavour to provide a reasonable replacement or rescheduled session.

  2. If SBE cannot provide a reasonable replacement or rescheduled session, the applicable fee will be credited or refunded.

  3. Any credit or refund will be subject to the services already supplied, the circumstances of the cancellation and any rights or remedies available under the Australian Consumer Law.

 

7. Photography and media consent

  1. Photography and media consent is optional and is recorded separately within the enrolment form.

  2. Where consent has been provided, you authorise SBE representatives to photograph and/or record your child during SBE activities.

  3. Approved photographs and recordings may be used in:

    • SBE educational and promotional materials;

    • the SBE website and social-media accounts;

    • electronic communications;

    • appropriate media coverage or publications relating to SBE; and

    • displays celebrating student activities, projects and achievements.

  4. Where appropriate, your child’s first name may be used in connection with an image.

  5. SBE will not publish your child’s surname or other identifying personal information in connection with an image without additional consent.

  6. No payment or compensation is payable for authorised use of photographs or recordings.

  7. You may withdraw photography and media consent at any time by providing written notice to SBE.

  8. Withdrawal will apply to future use and publication. Upon request, SBE will make reasonable efforts to remove identifiable material from digital channels it controls. SBE may be unable to retrieve material that has already been lawfully printed, distributed, shared or republished by another person.

 

8. Morning tea, lunch breaks, parks, libraries and social activities

  1. You give permission for your child to walk with SBE staff to nearby parks, libraries and other appropriate local locations for:

    • morning tea or lunch;

    • recreational activities;

    • educational activities;

    • Social Club; and

    • Holiday Club activities, where applicable.

  2. Students will remain under SBE supervision during these activities.

  3. SBE will take reasonable steps to consider weather, environmental conditions, group needs and student safety when conducting local activities.

  4. You are responsible for ensuring that your child attends with suitable clothing and sun protection, including a hat and sunscreen where required.

  5. Any excursion or activity requiring transport or travel beyond SBE’s usual local area may be subject to additional information and consent.

 

9. Medical information, illness and first aid

  1. You agree to provide accurate and current information about your child’s:

    • medical conditions;

    • allergies and sensitivities;

    • medications;

    • emergency needs; and

    • any other relevant health or support requirements.

  2. You must notify SBE as soon as reasonably practicable if this information changes.

  3. Medication will only be administered where appropriate arrangements, instructions and authorisations have been agreed upon with SBE.

  4. You consent to reasonable first aid being administered by an appropriately trained staff member where required.

  5. If your child becomes unwell or is injured, SBE may contact you, another parent or guardian, or the emergency contacts listed for your child.

  6. SBE may require your child to be collected if they are unwell, injured, unable to participate safely or may pose a risk of illness to others.

  7. Where SBE reasonably considers urgent medical attention necessary and a parent, guardian or emergency contact cannot be reached in sufficient time, you authorise SBE to seek appropriate emergency medical assistance.

  8. You are responsible for ambulance, medical or related expenses incurred on your child’s behalf, except to the extent that SBE is legally responsible for those expenses.

  9. SBE will make reasonable efforts to inform you as soon as practicable of any significant illness, injury or incident involving your child.

 

10. Behaviour of parents and guardians

  1. Parents and guardians must communicate respectfully with SBE staff, students and other members of the SBE community.

  2. Abusive, threatening, intimidating, discriminatory, harassing or aggressive behaviour will not be accepted.

  3. Serious or repeated inappropriate behaviour may result in SBE suspending, terminating or declining an enrolment.

  4. You acknowledge the personal and sometimes sensitive nature of information shared within the SBE community and agree to respect the privacy and confidentiality of other students and families.

  5. SBE reserves the right to refuse or discontinue services where reasonably necessary to protect the safety, wellbeing or appropriate operation of the SBE community, subject to applicable law.

 

11. Student behaviour and support needs

  1. SBE aims to provide a safe, inclusive and supportive learning environment for all students.

  2. Parents and guardians must provide relevant information about their child’s learning, behavioural, medical and support needs so that appropriate planning and reasonable support can occur.

  3. SBE will endeavour to work collaboratively with families when concerns arise.

  4. Where a student’s behaviour presents an ongoing or serious risk to themselves, other students or staff, SBE may implement reasonable safety and support strategies.

  5. SBE may suspend or discontinue a student’s enrolment where it reasonably determines that:

    • it cannot safely or appropriately meet the student’s needs;

    • serious behavioural concerns continue despite reasonable intervention;

    • necessary information has not been disclosed;

    • the student presents an unacceptable risk to themselves or others; or

    • ongoing or serious behaviour is incompatible with SBE’s values or its ability to maintain a safe and supportive environment.

  6. Except where immediate action is reasonably necessary for safety, SBE will endeavour to discuss serious concerns with the family before suspending or discontinuing enrolment.

  7. If SBE terminates an enrolment, any unused prepaid fees will be credited or refunded after deducting amounts lawfully owing, subject to the circumstances and applicable law.

 

12. Educational services and progress

  1. SBE will endeavour to provide high-quality educational support appropriate to the student and the services in which they are enrolled.

  2. Educational development and progress vary between students. SBE cannot guarantee any particular:

    • academic result;

    • rate of progress;

    • achievement level; or

    • educational outcome.

  3. Where SBE believes that it cannot appropriately support a student’s educational needs, it will endeavour to discuss this with the parent or guardian.

  4. Information and guidance provided by SBE are educational in nature and are not a substitute for medical, psychological, legal or other regulated professional advice.

 

13. Education and registration responsibilities

  1. Parents and guardians remain responsible for ensuring that their child meets all applicable education, enrolment, registration and reporting requirements.

  2. Depending on the child’s circumstances, this may include:

    • home-education registration;

    • enrolment with a distance-education provider;

    • enrolment in a state or non-state school; or

    • another lawful educational arrangement.

  3. SBE may provide educational planning, curriculum support and general assistance. However, responsibility for satisfying statutory registration, reporting and educational requirements remains with the parent or guardian.

  4. Enrolment with SBE does not, by itself, satisfy any legal requirement to register for home education or enrol in a recognised school or distance-education provider.

 

 

14. Privacy and personal information

  1. SBE may collect personal and sensitive information reasonably necessary to:

    • process and administer enrolments;

    • provide educational services and student support;

    • protect student health, safety and wellbeing;

    • communicate with families;

    • manage accounts and payments; and

    • meet legal and regulatory obligations.

  2. Information may be shared with SBE staff and service providers where reasonably necessary to provide services or administer the enrolment.

  3. Information may also be disclosed to emergency services, medical professionals, government authorities or other parties where:

    • necessary to protect a person’s health or safety;

    • authorised by the parent or guardian; or

    • required or permitted by law.

  4. SBE will take reasonable steps to protect personal information from loss, misuse, unauthorised access, modification or disclosure.

  5. Personal information will be handled in accordance with SBE’s Privacy Policy and applicable privacy laws.

 

 

15. Complaints and concerns

  1. Parents and guardians are encouraged to raise concerns with SBE as early as possible so that they can be considered and addressed.

  2. Complaints should be communicated respectfully and include sufficient information for SBE to understand the concern.

  3. SBE will endeavour to:

    • acknowledge the concern;

    • consider the relevant circumstances;

    • communicate with the people involved where appropriate; and

    • provide a reasonable response.

  4. Nothing in this section limits a person’s right to seek external advice or exercise any right available under applicable law.

 

16. Australian Consumer Law

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law.

 

17. Changes to these Terms and Conditions

  1. SBE may update these Terms and Conditions from time to time.

  2. Where a change is material and may reasonably affect a family’s rights or obligations, SBE will provide reasonable notice before the change takes effect.

  3. Updated Terms and Conditions will be made available to families through the SBE website, enrolment system or another appropriate communication channel.

  4. Where required, SBE may request renewed acceptance of materially updated terms.

 

18. General provisions

  1. These Terms and Conditions are governed by the laws of Queensland, Australia.

  2. If any provision is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to operate to the extent permitted by law.

  3. A delay by SBE in exercising a right under these Terms and Conditions does not waive that right.

 

19. Electronic acceptance

By ticking the “I have read and agree to the Sunshine Bridge Education Terms and Conditions” box in the SBE Google Form, you confirm that:

  1. you are the student’s parent or legal guardian, or otherwise have authority to complete the enrolment;

  2. you were provided with access to these Terms and Conditions before accepting them;

  3. you had an opportunity to read and consider them;

  4. you have read, understood and agreed to them;

  5. your electronic acceptance may be recorded as part of the student’s enrolment record; and

  6. these Terms and Conditions apply for the duration of the student’s enrolment, subject to any updates communicated by SBE.
